By creating an account, joining the waitlist, or using any part of Daydream, you agree to these Terms. If you do not agree, do not use Daydream.
1. Eligibility
You must be at least 18 years old to use Daydream. By accepting these Terms you confirm that you are 18 or older. We do not knowingly allow anyone under 18 to use Daydream. Accounts found to belong to a minor will be removed.
Daydream is currently available only in certain regions. We do not serve users located in the European Union, the European Economic Area, Switzerland, the United Kingdom, Australia, Canada, or in the U.S. states of New York, California, Utah, Texas, and Illinois. You are responsible for the security of your account credentials and for any activity that happens under your account. If you believe your account has been accessed without your permission, email .
You may not share, sell, or transfer your account to another person.
3. What Daydream is
Daydream is an AI companion experience. Every character, friend, agent, or companion on the platform is an AI system. None of them are real people, even when they speak in the first person and use names.
Conversations are generated by language models. They are not facts, advice, predictions, or professional opinions of any kind.
4. Not a substitute for professional help
Daydream is for entertainment and casual conversation. It is not a medical device. It is not a therapy service. It is not a mental health treatment. It is not a crisis service.
If you are in crisis, please contact a real person who can help:
- United States: call or text 988 for the Suicide and Crisis Lifeline
- Text HOME to 741741 to reach the Crisis Text Line
- For an international directory, visit findahelpline.com
Do not rely on Daydream for diagnosis, legal counsel, financial planning, medical decisions, or emergencies. Information generated by Daydream may be inaccurate, out of date, or harmful in your specific situation. Always check important decisions with a qualified human professional.
5. Acceptable use
You agree not to use Daydream to:
- Generate or solicit any content involving minors in a sexual context
- Plan, encourage, or carry out violence against yourself or others
- Plan or carry out illegal activity in your jurisdiction
- Impersonate Daydream, our staff, or any other person or company
- Scrape, crawl, reverse engineer, or otherwise extract data from the platform
- Attempt to access accounts, data, or systems that do not belong to you
- Bypass age, geographic, or safety controls
- Resell, redistribute, or commercially exploit anything you receive from Daydream without our written permission
We may suspend or close any account that violates these rules, with or without notice.
6. AI-generated content
You own the messages you send. We do not claim ownership of your prompts. AI replies are generated on the fly by third party language models and are not warranted to be original, factual, or non-infringing. You agree not to publish AI replies in ways that misrepresent them as the words of a real person or organization.
We may use anonymized, aggregated metadata (for example, how often a feature is used) to improve the service. We do not use the content of your conversations to train external models.
7. Payments and subscriptions
Some features of Daydream may require a paid subscription. Pricing, billing cycles, and feature tiers will be presented before you commit. Subscriptions renew automatically unless you cancel before the next billing date. We do not offer refunds for partial periods unless required by law in your jurisdiction.
We use third party payment processors. We do not store full card numbers on our servers.
8. Intellectual property
The Daydream name, logo, brand assets, the structure of the platform, and the underlying code are owned by Daydream and protected by intellectual property law. You may not copy, reverse engineer, redistribute, or create derivative works without our written permission, except where the law specifically allows it.
You may share screenshots and links for personal, social, or press purposes as long as you do not misrepresent yourself as affiliated with us and do not modify our trademarks or assets.
To report material on Daydream that you believe infringes your copyright, email with a description of the work and the specific material in question.
9. Your content
You keep ownership of the messages you submit. By submitting them, you grant Daydream a limited, worldwide, royalty free license to store and process them so we can deliver the service to you. We do not sell your messages. We do not share them for advertising. We may produce anonymized statistics about platform use.

12. Disclaimers

To the maximum extent allowed by law, we disclaim all warranties, both express and implied. This includes:

13. Limitation of liability
To the maximum extent allowed by law, Daydream and its officers, employees, and agents are not liable for:

Some jurisdictions do not allow these limits. Where that is the case, they apply only to the extent permitted.
14. Indemnification
If your actions cause a legal claim against Daydream, you agree to take on its defense, pay any resulting damages, and not hold us responsible. This applies to claims arising from:
- your violation of these Terms

15. Governing law and dispute resolution
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law principles. You and Daydream agree to resolve any dispute in the state or federal courts located in Georgia. You consent to personal jurisdiction in those courts and waive any objection to venue there.
To the maximum extent allowed by law, you waive any right to participate in a class action against Daydream.
16. Changes to these Terms
We may update these Terms. When we make a material change, we will update the date at the top of this page and require you to accept the new version before continuing to use the platform. Minor changes that do not affect your rights (typos, formatting, clarifications) will be posted without a re-acceptance prompt.
17. Severability and waiver
If a court finds any part of these Terms unenforceable, the rest of the Terms still apply. Our failure to enforce a term is not a waiver of that term.
